I. Overview

Allison Garner, operating as Thoughtly AI (the “Company,” “we,” “our,” or “us”), provides artificial intelligence–powered tools, features, and related services (the “AI Service”).

By accessing or using the AI Service, you agree to be bound by these Terms of Use (“Terms”).

If you do not agree, you may not use the AI Service.

II. Eligibility

You must be at least 18 years old to use the AI Service.

By using the AI Service, you represent that you meet this requirement.

 

III. Description of the AI Service

The AI Service provides dynamically generated responses based on user inputs.

Outputs are generated automatically by machine learning systems and are provided for informational and general-purpose use only.

IV. Acceptable Use

You agree not to use the AI Service:

  • For unlawful purposes
  • To generate harmful, abusive, or illegal content
  • To attempt to manipulate, exploit, or reverse engineer the AI system
  • To extract system prompts, models, or proprietary logic
  • To interfere with system performance or security
  • To collect personal data of others without authorization
  • To misrepresent AI-generated outputs as verified fact

We may suspend or terminate access for violations.

 

V. AI Output Disclaimer

You acknowledge that:

  • Outputs are generated automatically without human review
  • Outputs may be inaccurate, incomplete, or misleading
  • Outputs are not guaranteed to be unique
  • Similar outputs may be generated for other users

The AI Service does not provide:

  • Medical advice
  • Mental health diagnosis or treatment
  • Legal advice
  • Financial advice

You are solely responsible for how you use any outputs.

VI. User Inputs and Outputs

You may submit inputs (“Prompts”) and receive outputs (“Responses”).

  • You retain ownership of your inputs
  • We do not claim ownership of outputs provided to you

However:

  • Outputs are provided under a limited, non-exclusive license for personal or internal use
  • We make no guarantee regarding intellectual property status of outputs

VII. Third-Party Infrastructure

The AI Service may rely on third-party providers, including AI model and infrastructure partners.

We are not responsible for interruptions or issues caused by third-party systems.

VIII. Modifications to the Service

We may modify, suspend, or discontinue the AI Service at any time without notice.

We are not liable for any resulting impact.

IX. Fees and Billing

If applicable, you agree to provide accurate billing information and authorize charges for paid features.

We reserve the right to modify pricing at any time.

X. Disclaimer of Warranties

The AI Service is provided “as is” and “as available.”

We make no warranties regarding:

  • Accuracy
  • Reliability
  • Availability
  • Fitness for a particular purpose

XI. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • Errors or inaccuracies in AI outputs
  • Decisions made based on outputs
  • Loss of data, revenue, or business
  • Indirect or consequential damages

Your use of the AI Service is at your own risk.

 

XII. Indemnification

You agree to indemnify and hold harmless the Company from any claims arising from:

  • your use of the AI Service
  • your violation of these Terms

XIII. Termination

We may suspend or terminate access at any time for violations of these Terms.

You may stop using the AI Service at any time.

XIV. Governing Law

These Terms are governed by the laws of the State of Wisconsin, United States.

XV. Changes to Terms

We may update these Terms at any time. Continued use constitutes acceptance.
